A notorious serial burglar, habitual criminal and axe murderer was sentenced to life imprisonment plus forty two years at the Western Cape High Court sitting in Worcester.
On 31 December 2017, Jonathan Cupido (34) broke into the house of 81-year-old Worcester resident Joseph Oosthuizen and brutally attacked him. Oosthuizen was left with multiple injuries to the head, body including facial fractures and deep scalp bruising on the left side of his skull.
After the attack, Cupido left him for dead, but not before looting his house. He took meat, bedding, crockery and other items. Oosthuizen was found alive by friends who visited on New Year’s Day, but he passed away five days later.
On Wednesday 24 October the court convicted Cupido on all six charges he faced, which include housebreaking with the intent to rob and murder, attempted murder, two counts of housebreaking with the intent to steal and theft, housebreaking with the intent to rob and robbery with aggravating circumstances and murder.
Judge André le Grange sentenced Cupido to ten years direct imprisonment for house breaking with intent to rob and murder, twelve years for attempted murder, five years on each count for the two counts of housebreaking, ten years for housebreaking with intent to rob with aggravating circumstances and life imprisonment for murder. The court further declared him unfit to possess a firearm.
“The accused is a danger to society as his sentences for similar offences did not deter him from committing the current offences,” advocate Maresa Engelbrecht, for the state, argued.
The accused has four minor children aged 4, 8, 9 and 10 and they reside with their biological mother. Cupido is unemployed and only does part time jobs as a casual labourer and is a recipient of a government disability grant.
Cupido is not a first time offender; he has been in and out of prison since the year 2002 and has been in conflict with the law. In August 2017, barely three months after he was released on parole, he started with the current series of crimes.
According to Cupido in his plea of guilt, he gained entry into Oosthuizen’s yard by climbing over a fenced wall. Oosthuizen aw him and told him to leave the premises and that the police would be notified. Despite the warning, he moved to a different window and brazenly took a rock and broke the window pane to enter in the house, where he managed to enter the bedroom. The rocks hit Oosthuizen in the face and upper body. After that, Cupido went to the garden shed, obtained a garden fork and attacked Oosthuizen. He stabbed him in the chest and hand. Oosthuizen wrestled the garden fork from Cupido, after which he went back to the shed to fetch an axe and attacked him again.
