Disciplinary Board for Breede Valley Municipality

A Disciplinary Board (DB), which will investigate any financial irregularities, should any be reported, will be established at the local municipality.

This is in terms of municipal regulations and it has received the support and recommendation of the directorates at the recent council meeting of the Breede Valley Municipality (BVM). The objective of the regulations is to set out procedures that municipalities must follow when dealing with financial misconduct. The regulations apply to all officials and political office bearers within municipalities. “A Municipal Council must establish a Disciplinary Board to investigate allegations of financial misconduct in the municipality and monitor the institution of disciplinary proceedings against an alleged transgressor,” says the Speaker of the Breede Valley Municipality, Neil Mercuur.

The board will be an independent advisory board which will assist the municipal council with the investigation of allegations of financial misconduct. The board will also make recommendations based on the findings of the investigation on further steps to be taken regarding disciplinary proceedings or any other relevant steps. Members of the board will be skilled professionals and must consist of a maximum of five members appointed on a part-time basis by the BVM council for a period of not more than three years. In order to implement the regulations, it is proposed that a DB be established on a part-time basis for a period of three years, consisting of four members, namely the chief audit executive, senior manager: legal services, chairperson of the audit committee and any competent person seconded by provincial treasury. According to Mercuur, the chief audit executive and senior manager: legal services will be internal and the chairperson of the audit committee and persons seconded by Provincial Treasury will be external appointments. The financial implications in terms of remuneration will only be applicable to members of the DB outside the public service. It follows that the only remuneration payable will be to the chairperson of the audit committee. It is proposed that the remuneration be in accordance with Council’s approved audit committee charter.“The appointed Disciplinary Board members will receive appointment letters from the municipal manager and the appointments will be accepted in writing,” says Mercuur.
